IF YOU ARE INVOLVED IN A ROAD TRAFFIC ACCIDENT, NO MATTER WHO YOU THINK WAS TO BLAME:
- Always obtain the other driver's: car registration number, name, address and insurance details. Insurance must, by law be supplied if there is injury and it is an offence under the Road Traffic Act of 1988 not to do so.
- If the driver refuses to give you these details, still make a note of the registration number. The registration number and description of driver is vital in evidence.
- If there is personal injury make sure the Police are involved as they have little interest in damage only accidents, but are more likely to attend an accident with personal injury or if the third party has driven off without supplying details. So emphasise this when reporting to Police.
- Take photos of the damaged vehicles – don’t forget to use your camera phone! The resulting photographs may be used in evidence to assist claim.
- Sketch the road layout and show the path of the vehicles before and after the collision.
- NEVER admit liability. Even if you think you are at fault. IF other driver admits it, get that admission witnessed or written down if possible.
- Seek medical help even if slightly injured. Often there are no symptoms at the time and it is later that they develop. Some injuries may not become apparent until 48 hours after the accident. They need to have been recorded.
- Keep receipts of any expenses such as getting home by taxi or medication, days lost at work etc.
